A testator left money to a charity which was deregistered soon after his death.
The charity had left some of its assets to another charity, who claimed the bequest as the “successor” organisation of the original charity.
The court found the first charity had ceased to exist and did not have a “successor”, so the gift needed to be applied cy pres (there will now be another hearing to determine who the eventual recipient will be).
